You (and MS too) can scream this till you're blue in the face, but if the content owners don't meet consumer expectations over fair use it's the Microsoft product that will get the blame. It might hit sales too if MS gets a reputation for being the policeman.

As an example - at the moment iTunes has a consumer monopoly - the problem is the consumer probably doesn't know it yet. But wait till an iPod competitor comes along, or people wake up to alternatives as players reach mainstream media - then they will find out that they have to pay up again for the same content.

Now that might force the content holders to relax a little - but if they get it wrong the will blacken DRM the name in the mainstream for years (that might be a good thing)!! If they get DRM, and fair use right, then it may well survive.

They can get away with restrictive DRM now as the problem doesn't affect too many people...just the early adopters...
