Process Explorer 1.0

Seeing reports that Process Explorer 1.0 on some machines is eating up the CPU process.  For a workaround, some are reporting to open the task manager firs, then ProcMon.

But watch the EULA  http://www.microsoft.com/technet/sysinternals/information/licensingfaq.mspx

Q: May I freely load or use Sysinternals utilities on computers that I support but do not own?

A: No. You will need to contact Microsoft Sysinternals Licensing (syslic@microsoft.com) and inquire about fee based licensing options.

I read the EULA over, and couldn't find any reference that suggested I wasn't allowed to use ProcMon on any PC I liked. Can someone with a bit more of a legal bent comment?

I strongly believe that Process Monitor should be made available for free to volunteer malware fighters upon application, especially considering corporations can install PM as many times as they want on a corporate network.

So on a machine we don't own, we have to get the owner to come and sit at the keyboard and walk them through the download and installation of any sysinternal tools??

But then there is this:

Q: Will Microsoft change the licensing agreement for the Sysinternals tools and their use?

A: Yes, but we've made the license terms more liberal. Companies can now install and use the software throughout their organization, as opposed to a single user limitation.

Which to me negates the first rule. They need to clarify this.
